Perused the case diary including the statements of the minor victim and the other witnesses and the medical papers. The prosecution case is that the petitioner inappropriately touched the ten year old victim girl and another co-accused also sexually assaulted her in a fair. When the victim's uncle protested, the petitioner brought 15 to 20 more men and together assaulted the uncle leading to grievous injury including fracture of finger and injuries on vital parts of the body.

Considering the above, the alleged commission of atrocious acts by the petitioner and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
