05.04.2023 Ct. No.34 S/L No.21 KS C.R.R. 1405 of 2021 Samir @ Samir Shrivastav -Vs.- The State of West Bengal & Anr.

In Re.:- An application under Section 482 of the Criminal Procedure Code.

Mr. Arijit Ganguly Mrs. Debjani Sahu .....For the State None appears on behalf of the petitioner.

As directed earlier by this Court Mr. Arijit Ganguly, learned advocate appears on behalf of the State and submits a report. The report reflects that the allegations in the First Information Report could not be substantiated and, as such, on 21.06.2022 the investigation was closed by declaring as 'Mistake of Fact'. Let the report be kept with the record. In view of the contents of the report, the revisional application has become infructuous.

Earlier as per this Court's order dated 16.11.2021 Mr. Arijit Ganguly, learned advocate who ordinarily appears on behalf of the State was directed to appear in this matter verbally. His appointment be regularized as he has submitted a report before this Court. The concerned authorities will take steps for regularizing his appointment in this particular revisional application.

Accordingly, C.R.R. 1405 of 2021 is dismissed as infructuous. Pending applications, if any, are consequently disposed of.
