The defendant in a suit for recovery of money is the petitioner of the instant application under Article 227 of the Constitution which is directed against the order dated March 16, 2024 passed by the learned Judge, Commercial Court, Rajarhat in the said suit being Money Suit No. 97 of 2024(Com).

The learned Trial Judge, by the order impugned, has dismissed an application filed by the petitioner praying supply of legible copies of the documents relied on by the plaintiff on the ground that the written statement has already been filed. The defendant will be entitled to have inspection of the original documents relied on by the plaintiff at the appropriate stage of the suit, therefore, the direction as prayed for, has become redundant as the defendant has already filed a written statement without having inspection of the legible copies of the said document.

The order impugned does not call for any interference. C.O. 1435 of 2024 is disposed of with the above observations without any order as to costs.
