Ali Road, P.S. - Ekbalpore, Kolkata - 700 023.

The petitioner claims to be a tenant under Respondent No. 4.

In compliance with the order dated June 26, 2025, passed in this writ petition, the Calcutta Electric Supply Corporation Limited (CESC) conducted an inspection at the said premises with police assistance on July 17, 2025. Learned counsel appearing on behalf of CESC submits that CESC is ready and willing to provide electricity connection to the petitioner, subject to the petitioner's compliance with all requisite formalities.

The prayer of the petitioner is, however, opposed by Respondent No. 5. Learned counsel for Respondent No. 5

submits that, admittedly, the petitioner is a tenant under Respondent No. 4 and, therefore, cannot be granted electricity connection from a meter board that is located in a portion of the premises under the ownership of Respondent No. 5.

It appears from the records that the premises in question-11/1/H/2, Moulana Md. Ali Road, P.S. - Ekbalpore, Kolkata - 700 023-is a jointly owned property held by multiple co-sharers. Although Respondent No. 5 claims exclusive ownership of the portion where the existing meter board is located, no document evidencing such exclusive ownership has been placed before this Court.

In view of the above, this writ petition is disposed of with the following directions:

CESC shall provide the electricity connection to the petitioner within two weeks from the date of this order, subject to the petitioner's compliance with all necessary formalities.

The Officer-in-Charge, Ekbalpore Police Station, is directed to extend all necessary assistance to the officials of CESC for implementation of this order.

The cost of police assistance shall be borne by the petitioner.

The police shall be at liberty to break open the padlock of the meter room, if necessary, for the purpose of effecting the electricity connection.

Accordingly, WPA 10401 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
