... for the petitioner The present petition has been filed for the transfer of Title Suit No. 1282 of 2024 in the Court of learned Civil Judge (Jr. Divn.), 5th Court, Alipore, South 24-Parganas to any other Judge of competent jurisdiction.

After some argument, learned counsel confines his prayer to the extent that a direction may be issued to the learned Trial Court to dispose of the applications under Order 39 Rule 4 of the Code of Civil Procedure, 1908 and Section 151 of the Code of Civil Procedure, 1908 pending on record, expeditiously in accordance with law. The Court without taking into account the averments in the petition, direct the learned Trial Court to dispose of the application filed by the defendant/petitioner under Section 151 of the CPC and Order 39 Rule 4 of the CPC, positively within eight weeks after giving the opportunity of being heard to both the parties.

The petition being CO 1645 of 2025 stands disposed of.
