Learned advocate appearing for the petitioner submits that in view of incurable defects in the writ petition, the petitioner intends not to press the same and seeks leave to file fresh petition upon the selfsame cause of action.

In view of such submission, the writ petition stands dismissed as 'not pressed'.

It will be open for the petitioner to file fresh petition upon proper and better particulars.

In the order dated 4th December, 2023 due to inadvertence, the appearance of the learned advocate appearing for the Corporation has been recorded for the Howrah Municipal Corporation. The same should read as Durgapur Municipal Corporation.
