Affidavit-of-service filed in Court today by the Counsel for the petitioner is taken on record. The writ petitioner is aggrieved by the fact that Nischinda Police Station, Howrah Police Commissionerate has not completed investigation into F.I.R. No. 4 of 2021 dated 4th January, 2021,under Sections 279 and 304 A of the IPC.
It is submitted by the Counsel for the petitioner that his son, who was 17 years old, had died in the incident, which is subject matter of the FIR. Counsel for the State submits that investigation is on the verge of completion and final report may be submitted in a day.
Private respondents are also represented.
It is also submitted by the Counsel for the petitioner that the private respondents have been impleaded since they were the friends of the deceased son of the petitioner, who may have been present at the time of incident.
This Court cannot make any observation on the apprehension of the petitioner.
Be that as it may, the Officer-in-charge, Nischinda Police Station, Howrah Police Commissionerate shall complete investigation and submit final report before the jurisdictional Magistrate within a period of one month from date mandatorily and positively. A copy of such final report may be supplied to the writ petitioner or his learned Advocate. With the aforesaid observations, the instant writ petition shall stand disposed of.
There will be no order as to costs.
All parties are directed to act on a server copy of this order on usual undertakings.
