AGP Mr. Subrata Guha Biswas ...for the State Mr. Lal Ratan Mandal Mr. Dilip Kumar Sadhu ...for the private respondent The petitioner is aggrieved by the non-consideration of his representation dated April 16, 2025 made inter alia to the respondent No. 5. The petitioner complains of illegalities having been committed in granting permit to the respondent No. 8.

The learned advocate appearing for the respondent No. 8 submits that the permit has been granted rightly. Without going in to the merits of the controversy as regards the legality and validity of the permit granted in favour of the respondent No. 8, this writ petition is disposed of by directing the respondent No. 5 to take a decision on the petitioner's representation dated April 16, 2025, strictly in accordance with law by passing a reasoned order upon giving an opportunity of hearing to the petitioner as well as the respondent No. 8 within a period of four weeks from the date of communication of this order.

It is needless to mention that the respondent No. 5 shall communicate such reasoned order passed within the aforesaid time frame to the writ petitioner and the private respondent No. 8 within a week from passing thereof.

With the above observations, WPA 10448 of 2025 is disposed of.

There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai , J.)
