This is absolutely a frivolous application as because this matter has been filed making allegations against one interview list which was published on 21st June, 2021 by the West Bengal Central School Service Commission and became ineffective and non-existent due to publication of a subsequent interview list on 08.07.2021 in compliance of this Court's order for disclosing break up of marks of the candidates. After publication of the said new interview list this writ application has become infructuous as an order was passed by this court in WPA 10789 of 2021 (Abhijit
Ghosh vs. State of West Bengal & Ors.) on 9th July, 2021 giving certain directions upon WBCSSC. Thereafter WBCSSC notified, for the candidates, an announcement dated 10th July, 2021, for submitting representation to it. The petitioner has filed the representation also following the said notification. Therefore, the petitioner had the knowledge before moving this application today about the order passed by this court on 02.07.2021 and 09.07.2021. Despite such knowledge this application is being moved. Today, it is not understood at all why this infructuous application is being moved on the basis of the ineffective and non-existent interview list. The petitioner has shown different documents from the annexures of the application in support of her grievances.
From the said representation of the petitioner which she has already filed it is found that all of the grievances of the writ petitioner as have been made in the writ application have been raised in the said representation also. A copy of the said representation has been placed before this court which is kept on record. Consideration of the said representation is pending and the WBCSSC is expected to deal with it as directed by the court.
I am told that the order passed by this court in WPA 10789 of 2021 has been carried to appeal and the
appeal court has passed an order on 20.07.2021 and thus the order passed by this court on 9th July, 2021 in WPA 10789 of 2021 has been merged.
As this is wholly a frivolous application being infructuous and has been moved without any understandable reason, the writ application is dismissed with costs of Rs. 5,000/- to be paid by the petitioner to the High Court Legal Services Authority within a period of two weeks from date. Registry to report compliance of payment of costs as directed after 10.08.2021.
