WPA 10515 of 2024 and WPA 10146 of 2024 are disposed of together, as the issues are connected. 2.
WPA 10146 of 2024 has been filed by Subrata Chatterjee, who alleges that the West Bengal State Electricity Distribution Company Limited was trying to supply electricity to M/s. Shree Shyam Baba Foods, who is the petitioner in WPA 10515 of 2024, by erecting a pole right in front of his house.

Learned advocate for the petitioner in WPA 10515 of 2024, submits that there is adequate space on the road and the electricity connection can be
given from a pole which can be erected on the said road.

Learned advocate for the petitioner in WPA 10146 of 2024, also submits that there is available space on the road and the pole should not be erected in front of his house.

Having heard the learned advocates for the parties, both the writ petitions are disposed of directing the Superintending Engineer (Commercial), Paschim Medinipur Region, to constitute a team of his choice and hold an inspection of the premises of both Subrata Chatterjee and M/s. Shree Shyam Baba Foods, in presence of the parties. The inspection will be held to identify, demarcate and delineate a specific place on the available road by the side of which the pole can be erected, for grant of connection to M/s. Shree Shyam Baba Foods. The only pre-caution that the authorities are to take, is to ensure that the pole is not erected right in front of the gate of Subrata Chatterjee, i.e., Subrata Chatterjee should have free egress and ingress.

The writ petitions are disposed of with further direction that if it is found that extra cables or equipments are required to use an alternative route, then the petitioner in WPA 10515 of 2024 being M/s. Shree Shyam Baba Foods will bear the
cost. The entire exercise shall be completed within a period of two months from the date of communication of this order.

It is made clear that the distribution company must ensure supply of electricity, as no one can be kept in the dark in the year 2024.

All the parties are directed to act on the basis of the server copy of the order.
