Counsel for the State is aggrieved that an application under Section 5 of the RTI Act, 2005 has not been replied to by the Superintendent of Police, Hooghly. The petitioner has preferred an appeal to the appellate authority in vain. Aggrieved by the failure on the part of the respondent to provide information, he has approached the State Information Commission which has not disposed of the same.

Counsel for the State submits that the information sought would impact pending judicial proceedings and hence information cannot be furnished to the petitioner in view of Section 8(1)(h) of the RTI Act, 2005. Hence, no relief is granted to the petitioner and the writ petition is dismissed.

There shall, however, no order as to costs.
