Arun Basak v. State Of West Bengal
10.06.2022 tkm/ct 28 C.R.M. (DB) 1518 of 2022 sl no. 39 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Taherpur PS case no. 13/2020 dated 1.2.2020 under sections 302/120B/201/34 IPC And In Re : Arun Basak ........ petitioner Mr. Sandip Chakraborty Mr. A Das Ms. A Dey ...... for the petitioner Mr. M Sur Mr. D Paramanick ...... for the State Petitioner renews his prayer for bail and submits that he is in custody for more than two years.
Learned lawyer for the State opposes the prayer for bail and submits that date has been fixed for recording evidence. We have considered materials on record including the statement of witness disclosing prima facie role of the petitioner in the alleged crime. Date has been fixed for recording evidence. In view of the aforesaid facts, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail is rejected. Trial court is directed to conduct the trial as expeditiously as possible and conclude the same preferably within one year from the next date fixed for recording evidence without granting adjournments to either of the parties.
