1. Learned Advocate appearing for the petitioner submits that petitioner is similarly situated as the other accused person who has been granted bail in CRM (NDPS) 613 of 2026.

2. Learned Advocate for the State opposes the prayer for bail but is unable to refute the contention that the petitioner is not on the same footing as Sanaul Hoque @ Senaul who has been granted bail.

3. In view of the aforesaid Learned Special Court (NDPS Act), Malda is directed to release the petitioner on bail on same terms and conditions as was imposed upon the other accused in CRM (NDPS) 613 of 2026.

4. Accordingly, CRM (NDPS) 975 of 2026 is allowed.

5. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

6. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
