Commercial quantity of contraband items was allegedly recovered from the petitioner. In view of the restriction in Section 37 of the NDPS Act, we are not inclined to entertain the petitioner's prayer for bail.

However, the petitioner says that he is in custody for over one year. Charge sheet has been submitted. Learned Advocate for the State is not sure if the chemical analysis report is available.

In the event the chemical analysis report has not yet been obtained, the State shall obtain the same and file the same before the learned Trial Court within four weeks from date. We request the learned Trial Judge to expedite the consideration of charge thereafter and generally bring the trial to an early conclusion to the extent the business of the Court may permit. C.R.M. No.4546 of 2021 is, accordingly, dismissed. The Registry shall communicate this order to the learned Trial Court as also to the Director, State Drug Control and Research Laboratory, 2nd Convent Lane, Kolkata - 700 015.
