1. Affidavit of service is taken on record.

2. The writ petition is disposed of directing the Principal Secretary, Urban Development Municipal Affairs Department, Government of West Bengal to dispose of the representation of the petitioner dated October 21, in accordance with law. If the authority finds that either partial payment or full payment as claimed in the said representation should be made, such payment shall be released within three months from the date of communication of this order. If the authorities are of the view that payment cannot be made to the petitioner, then reasons for not allowing such payment shall also be intimated within three months from the date of communication of this order. The question of delay shall not be a ground for rejection of the claim, if the authority is satisfied that the claim is either fully or partially valid. The authority responsible for supervision of the work and the

petitioner, shall be heard. The order should be communicated within a week from such decision.

3. As no affidavits have been called for, the allegations are deemed to be denied. This order shall not be construed as mandate on the authority concerned to pay the money claimed by the petitioners.

4. Accordingly, the writ petition stands disposed of.

5. All the parties are directed to act on the basis of the server copy of the order.
