Kalawati Devi v. State Of West Bengal & ORS.
15.03.2021 (Through Video Conference) Item no. 02 Dd/aloke WPA 7700 of 2012 Kalawati Devi Vs.
The State of West Bengal & Ors.
Mr. Kallol Mondal, adv.
Mr. Krishan Ray, adv.
... For the Petitioner Mr. Rana Mukherjee. Ld APP Mr. Sabir Ahmed, adv.
... For the State This is a writ petition instituted in 2012 by one Kalawati Devi with the assistance of the State Legal Services Authority (SLSA). Her plea is that her husband, Nandlal Ram, was missing and needs to be traced out by the police.
Mr. Mukherjee, learned APP, has placed before us a report dated 15.03.2021 filed by Inspector-incharge, Chinsurah Police Station, Chandannagar Police Commissionerate. It appears therefrom that the police came to the conclusion that Nandlal Ram is not traceable and the whereabouts of the writ petitioner, Kalawati Devi is also not known for the last nearly eight years.
Intertwined with the aforesaid, the police appear to have traced out the daughter of the petitioner, Pinki Ram. She made a statement before the jurisdictional Magistrate under Section 164 Cr. P.C. and refused to undergo any test for medico legal opinion. The police have, however, filed a
case against some persons. We dispose of this writ petition keeping in view the fact that the final report has already been filed in that case.
Accordingly, WPA 7700 of 2012 is disposed of. [Thottathil B. Radhakrishnan, C.J] [Aniruddha Roy, J.]
