The grievance of the petitioners is that the benefit under the 'House for All' scheme was not granted in their favour though they are eligible for the same. On the contrary, persons who are not entitled as per the scheme have been enlisted for grant of such benefit.

A complaint was lodged before the Sub-Divisional Officer, Contai in December 2022. The same is alleged to be kept pending.

Learned advocate appearing for the Municipality submits that list referred to by the petitioners is a tentative list and not a final one.

As it appears that the petitioners have already ventilated their grievances before the respondent

authority, accordingly, the instant writ petition is disposed of by directing the Sub-Divisional Officer, Contai to consider the representation filed by the petitioners in accordance with the prevailing guidelines/rules/circulars and after giving a reasonable opportunity of hearing to all the necessary parties. A reasoned order shall be passed and communicated to the parties.

If the petitioners are found entitled to receive the benefit, the same shall be accorded in their favour. If it appears that ineligible candidates were enlisted for grant of benefit, then necessary steps shall be taken to delete their names from the tentative list. Steps shall be taken in the matter at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
