2025-05-16Hon'Ble Justice Jay Sengupta2 pages

AD 40 May 16, 2025 Ct. 28 SG CRM(A) 1593 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Swarupnagar P.S. Case No.236/2024 dated 25.04.2024 under Sections 498A/302/34 of the IPC.

And In the matter of:

Khukurani Sarkar ... petitioner Mr. Susnigdho Bhattacharyya Ms. Sarmistha De ... for the petitioner Mr. Anwar Hossain Mr. Sujoy Sarkar ... for the State Learned counsel for the petitioner submits that the petitioner is the mother-in-law of the alleged victim. The principal accused being the husband and the brother-in-law of the victim were granted anticipatory bail. The marriage between the couple took place three years ago. The present petitioner is not at all responsible for the suicide committed by the victim.

Learned counsel for the State opposes the prayer for anticipatory bail, relies on the statements of the victim's mother, neighbours and other witnesses and submits that the father-in-law was arrested in connection with this case. The main allegations are against the father-in-law and the motherin-law.

Considering the serious nature of allegations and the alleged role ascribed to the present petitioner, I am not inclined to grant anticipatory bail to the petitioner. The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
