1. Learned Advocate appearing for the petitioner submits that petitioner is similarly placed as the other accused namely Sk. Rabban who has been granted bail in SLP (CRL.) No. 5965 of 2026. As such the petitioner may be released on bail.
2. Learned Advocate for the State opposes the prayer for bail but is unable to refute the contention that the petitioner and Sk. Rabban is on similar footing.
3. Having considered the same I direct the learned Trial Court to release the petitioner namely Md. Kurban Khan on bail on furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act, Suri, Birbhum.
4. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the district of Birbhum without prior permission of the learned Special Court.
5. Accordingly, CRM (NDPS) 978 of 2026 is allowed.
6. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.
7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
