1. Learned Advocate appearing for the petitioner submits that petitioner is in custody for one year three months. Alleged recovery in the present case is 348 grams of heroin. Prosecution has already submitted charge-sheet. Charges have already been framed but witness action has not commenced.

2. Learned Advocate for the State opposes the prayer for bail and submits that the prosecution has relied upon 17 witnesses in order to prove its case.

3. Mr. Rajendra Banerjee, learned APP along with Mr. Bankim Pal was directed to appear. Their appearance may be regularized by the concerned authorities.

4. Be that as it may I have taken into account the period of detention, chemical examiners report and the petitioner being covered by the judgment of the Hon'ble Supreme Court in [Sentu Seikh-Vs- State of West Bengal [SLP (Crl.) No. 13987 of 2025].

5. Having regard to the totality of the circumstances I am inclined to release the petitioner on bail.

6. Accordingly, the petitioner, namely, Maidul Ali shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act, 2nd Court, Berhampore, Murshidabad.

7. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the district of Murshidabad without prior permission of the learned Special Court.

8. Accordingly, CRM (NDPS) 979 of 2026 is allowed.

9. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
