In Re: CRAN 1 of 2021 The reasons so assigned in the application under Section 5 of the Limitation Act are found to be just and sufficient. As such, the prayer for condonation of delay in respect of 129 days in preferring the revisional application is hereby condoned. Thus, CRAN 1 of 2021 is allowed.
In Re: CRR 1428 of 2021 The revisional application has been preferred challenging the order dated 24th November, 2020 passed by the learned Additional District and Sessions Judge, City Sessions Court, Calcutta wherein an additional charge under Section 120B of the Indian Penal Code was framed along with Sections 302/34/394 of the Indian Penal Code. The said order was passed on 24th November, 2020. There has been no participation of the petitioner
before this Court. No information has been furnished regarding the present stage of the proceedings before the learned sessions court. Mr. Arijit Ganguly, learned advocate, assists learned Public Prosecutor in the instant case.
In view of the time period which has lapsed in the meantime and presumably the trial has progressed, no interference is called for with the merits of the case. Petitioner would be at liberty to canvass such point at the stage of the final argument of the case provided the trial of the case is still pending. With the aforesaid observations, CRR 1428 of 2021 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
