The distribution company and the private respondent are represented.
The learned advocate appearing for the private respondents submits that the petitioner is his son and that the petitioner is enjoying electric supply. His client was ousted from his residence for which a writ petition is pending.
Learned advocate appearing for the distribution company submits that the private respondents appearing in the matter obstructed the distribution company from granting electric supply.
A person in settled possession is entitled to electric supply.
The distribution company will proceed to provide the electric supply to the petitioner, subject to the technical
feasibility thereof and upon payment of all costs, charges and expenses thereto by the petitioner. The distribution company is at liberty to obtain police assistance in the event the distribution company faces any obstruction at the time of inspection and energizing of the meter. The local police authorities are directed to render adequate police protection to the distribution company to provide electric supply to the petitioner.
It is expected that the electric supply is granted to the petitioner within a fortnight from date.
It is clarified that this order will not create any equity, right, title and interest in favour of the petitioner other than those that the petitioner enjoys.
WPA 11138 of 2021 is disposed of accordingly. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Debangsu Basak, J.)
