In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the defendant/opposite party is deemed necessary. In view of the inordinate delay in disposal of the suit filed by the petitioners in the court below and since the suit, for declaration, injunction and recovery of possession, is pending only at the stage of framing issues despite being filed in the year 2018, C.O. 1267 of 2021 is disposed of in terms of the following directions: The Civil Judge (Junior Division), First Court at Barasat, District-North 24 Parganas shall dispose of Title Suit No.762 of 2018 pending in the said court, along with all connected applications, if any, as expeditiously as possible, positively within one year from the date of communication of this order to the court below. The court below shall act on the communication of the learned advocate for the petitioners, accompanied by

a server copy of this order, without insisting upon prior production of a certified copy.

The petitioners shall communicate this order to the court below as well as to the opposite party and/or the learned advocate appearing for the opposite party, if any, in the court below at the earliest.

There will be no order as to costs.
