The present writ application has been preferred praying for direction upon the Controlling Authority where the prayer of the petitioner is pending since 04.06.2016.

It is further submitted that during pendency of the proceedings before the Controlling Authority the workman expired.

The petitioner has also made an application for substitution which is at page 33 being Annexure P6. It is stated that in spite of such application, no action has been taken by the Controlling Authority, Chandernagore, Hooghly till date.

Considering the materials on record, the conduct of the Controlling Authority, Chandernagore, Hooghly appears to be very negligent and as such the

notice of the Labour Commissioner, West Bengal is brought to the present case.

It is thus directed that the Labour Commissioner, West Bengal shall ensure that the Controlling Authority acts in accordance with law expeditiously in all cases. The conduct of such officers is to be regularly monitored and supervised by the senior/superior officers and above all the Labour Commissioner.

Accordingly, the Controlling Authority, Chandernagore, Hooghly is directed to complete the proceedings within 30 days from the date of communication of this order.

Parties to act on the basis of server copy of this order duly downloaded from the official website of this Hon'ble High Court.

Let a copy be served upon the Labour Commissioner, Government of West Bengal for compliance.

The writ application stands disposed of.

Be it noted that this Court has not gone into the merit of the case and the Controlling Authority shall decide the case in accordance with law, on the basis of materials on record.
