Anindita Mukherjee v. Sujit Kumar Maity And ANR
23.06.2022 akb/ss C.P.A.N. 448 of 2021 In W.P.A. 2258 of 2021 Anindita Mukherjee Vs.
Sujit Kumar Maity & anr.
Mr. Washef Ali Mondal ... for the petitioner Mr. Pinaki Dhole Ms. Kakali Samajpati ... for the alleged contemnors Mr. Dhole, learned Counsel appearing on behalf of the State submits that the C.P.F. of the petitioner has been converted to G.P.F.
Affidavit of compliance in this regard has been filed. Let the same be taken on record.
The pension payment order of the petitioner has also been issued and the petitioner has now received the pension.
Mr. Washef Ali Mondal, learned Counsel appearing on behalf of the petitioner submits that the petitioner had made an application of commutation of 30% of her pension, which has not been done.
In my view, this issue that has been raised by the petitioner now is a fresh cause of action and no order can be passed in the contempt proceeding.
Accordingly, the contempt petition is disposed of without passing any further order.
The petitioner is at liberty to approach the appropriate forum, if so advised.
