Chattopadhyay ....for the WBSEDCL It is submitted candidly by learned counsel appearing for the petitioner that, during pendency of the matter, the Distribution Company has already given a new connection from a separate meter in the name of the petitioner on the application of the petitioner.

As such, this writ petition has become infructuous.

Learned counsel for the Distribution Company agrees to such submissions.

Accordingly, WPA No.9885 of 2005 is dismissed as infructuous.

It is made clear that the merits of the matter have not been gone into by this court.

In view of the above order, the direction for filing of affidavits becomes redundant and is deemed to stand waived.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
