Learned counsel for the appellants Ms. Nibedita Chakraborty submits on instruction that her clients would quit and vacate the premises in question and hand over its vacant possession to the respondent by 31st January, 2024.

We record the said statement as an undertaking of the appellants to this court and simultaneously decree that the appellants should quit, vacate and deliver vacant possession of the subject premises to the respondent by 31st January, 2024.

The claim for mesne profits is kept open.

Nothing survives in the appeal (FAT 130 of 2021), which is accordingly decreed in terms of this judgement. S.D.
