Sri Pradip Kumar Mullick Mr. Biswarup Paine ...for the Petitioner In this application, the petitioner had made a prayer for a direction upon the court below for expeditious disposal of the interim maintenance application filed by the petitioner under Section 144 of the BNSS.

Learned counsel for the petitioner submits that it appears from the record that the marriage between the parties took place on 1.5.1993 according to Hindu Rites and Customs and the petitioner gave birth a male child, who was born on 6th May, 1994 due to said wedlock and thereafter, the parties were also blessed by a female child on 4th February, 1998. The petitioner herein filed the maintenance application along with a prayer for granting interim maintenance on 6.7.2024 and since then, it is pending for disposal. Therefore, the petitioner has prayed for making a necessary direction upon the court below for expeditious disposal of the interim maintenance application.

Since the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice

and as such, the service of copy of application upon the opposite party is hereby dispensed with.

Having heard learned counsel for the petitioner, the instant application being CRR 1956 of 2026 is hereby disposed of with a direction upon the court below or the court-in-charge of the court below to dispose of the interim maintenance application filed by the petitioner dated 6.7.2024 on the next date i.e. 16.5.2026 or preferably within a period of one month thereafter.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
