For the Respondent nos. 9-12 The petitioner claims to be a co-sharer in respect of the plot in question with the private respondents and alleges that that the private respondents are raising construction in a portion of the said plot without obtaining sanction from the concerned Panchayat. A partition suit is pending between the parties. The petitioner submitted a representation in this regard before the concerned authority on 27th April, 2026 and seeks consideration of the same.

Denying such allegation, learned counsel for the private respondents submits that the predecessor in interest of the petitioner sold out a portion of the plot being no. 2706 to the private respondents in 1991. The private respondents are raising construction therein under the Banglar Bari (Gramin) Scheme for which no sanction is required.

The contention of the private respondents needs to be verified by the concerned authority.

Since the representation submitted by the petitioner in this regard is pending, the Pradhan, Basudevberiya 8 No. Gram Panchayat, being the 8th respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law.

The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law.

It is made clear that the 8th respondent shall deal with the issue of alleged unauthorised construction raised by the private respondents without sanctioned building plan under the Banglar Bari (Gramin) Scheme and shall not deal with the issue of title or possession of the parties in respect of the property.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
