The present revisional application under Section 439 has been preferred for relaxing the condition of bail of the accused/husband/petitioner granted by learned Additional Chief Judicial Magistrate, Barrackpore on 31st May, 2022 in Titagarh Police Station Case No. 343 of 2022. By the impugned order, the learned Additional Chief Judicial Magistrate, Barrackpore was pleased to observe that custodial detention of the accused/husband/petitioner is not required for the purpose of investigation and as such, the bail petition made by the present petitioner/accused was allowed, but in interim form with the condition to meet the I.O. once in a week for one month.

Petitioner submits that he has already complied the said order and has attended on four occasions at the P.S. as directed by the learned Magistrate.

In view of the aforesaid compliance made by the accused/husband/petitioner, the prayer for relaxation of the said condition of interim bail has now become infructuous.

However, in view of the fact that the petitioner has attended the local P.S. on four occasions in compliance of the order dated 31st May, 2022, liberty is given to the husband/petitioner to approach before the trial court for confirmation of the interim bail. In the event such prayer is made by the husband/petitioner before the concerned Magistrate, the Magistrate will dispose of the same after considering the fact of his attendance at P.S. in terms of order and other materials, if any, at the earliest. Photostat copy in support of attendance of the petitioner at the P.S. be kept with the record. CRM (SB) 131 of 2022, is, thus, disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
