Petitioner has prayed for expeditious disposal in respect of Complaint Case No.2490 of 2022 pending before the learned Judicial Magistrate, 3rd Court, Alipore.

Records reflect that an application under Section 23 of the PWDV Act which relates to interim monetary relief is still pending. The next date is fixed on 09.05.2024. I direct the learned Judicial Magistrate to dispose of the application for interim monetary relief on 09.05.2024 or within a fortnight thereafter preferably by 24th May, 2024.

The learned Magistrate thereafter would fix one date in every 45 days for the purposes of the present case so that the evidence of the case progresses and all efforts be taken by the parties to conclude the trial at the earliest. In case any issues including the filing of affidavit of assets and liabilities, delayed tactics are adopted by the opposite party no.2 before the learned trial court, the learned trial court will not stall the proceedings for the same.

With the aforesaid observations, CRR 1695 of 2024 is

disposed of.

Pending connected application, if any, is consequently disposed of.
