The petitioner says that he has been falsely implicated. The victim is a resident of the same area where the petitioner resides. There was an affair between them. The victim, being pressurized by her family, has lodged this complaint.

We have seen the statements of the victim girl, 13 years old, recorded under Section 164 of the Code of Criminal Procedure as also under Section 161 thereof. She vividly described the heinous act that the petitioner had allegedly indulged in. The medical report also corroborates the version of the victim girl.

On an overall consideration of the incriminating material on record and the prima facie complicity of the petitioner in the alleged offence, and given the nature and gravity of the alleged offence, we are not inclined to grant bail to the petitioner, at this stage.

The application for bail being CRM 4574 of 2021 is, thus, dismissed.

However, the petitioner says that he is in custody for about one year. Charge Sheet was submitted in November, 2020. There has been no progress in the trial. In view of the lengthy detention of the petitioner, we request the learned trial Court to expedite the consideration of charges and generally bring the trial to an early conclusion to the extent the business of the court may permit.
