...for the alleged contemnors In Re: CPAN 138 of 2018 Mr. Pinaki Dhole, learned Counsel appears and submits that he has received instruction to represent the alleged contemnors. Mr. Anjan Bhattacharya, learned Counsel for the petitioner submits that a copy of the application was served upon the alleged contemnor in the year 2018 itself before listing of this matter. Be that as it may, in view of the order passed by the Hon'ble Supreme Court on 23rd July, 2019 by which the Special Leave Petition preferred by the State was dismissed, the order has now attained finality and is required to be implemented. Mr. Dhole, learned Counsel submits that the personnel to the office has changed during pendency of this matter and the new incumbent has joined in the meantime.
Leave is given to Mr. Bhattacharya to add Dr. P. Ulaganathan, the Secretary, Department of Panchayat and Rural Development, as respondent/contemnor.
The alleged contemnor shall file an affidavit of compliance on or before the adjourned date upon prior service to Mr. Bhattacharya, Advocate representing the petitioner in CPAN 138 of 2018.
In Re: CPAN 547 of 2018 Mr. Dhole, learned Counsel submits that the personnel to the office has changed during pendency of this matter and the new incumbent has joined in the meantime.
Leave is given to Mr. Indranath Mitra, learned Counsel, to add Ms. Ishani Pal, Superintendent of Police, Nadia, as respondent/contemnor.
Mr. Mitra further submits that during the pendency of the present contempt application another application has been filed being CPAN 1371 of 2019. An affidavit of compliance in CPAN 1371 of 2019 shall be filed also on the returnable date. The application shall also appear on the adjourned date. In Re: CPAN 86 of 2018 Mr. Dhole, learned Counsel submits that the personnel to the office has changed during pendency of this matter and the new incumbent has joined in the meantime.
Leave is given to Mr. Sukumar Ghosh, learned Counsel, to add Ms. Antara Acharya, Principal Secretary to the Government of West Bengal, as respondent/contemnor.
All the matters stands adjourned till 28th September, 2022 at 2 PM.
Copies of the contempt applications shall be served upon Mr. Dhole who has received instruction to represent the alleged contemnors in these proceedings by tomorrow.
Affidavit of compliance shall be filed on or before the adjourned date upon prior service to the petitioners in the
respective contempt applications.
In the event the order is not complied with within the aforesaid period, we may be constrained to issue a Rule of Contempt against the alleged contemnors.
