This is an application praying for expeditious disposal of Special Case No.273 of 2023 pending before the learned Additional Sessions Judge, 2nd Court, Alipore, South 24 Parganas arising out of Haridevpur P.S. Case No.300 dated 14.10.2022 under Sections 341, 323 and 506 of the Indian Penal Code read with Section 6 of the POCSO Act. 2.
Learned counsel appearing on behalf of the accused petitioners submits as follows. This is an unfortunate case where a false accusation has been brought against the father of the alleged victim about committing sexual assault upon the said minor victim. In 2022, the FIR was lodged. In December 2022, a charge sheet was submitted. There are 8 witnesses in all. Yet, till date, the proceeding has not been concluded. Dates are being
fixed every three months. This delay is causing serious prejudice to the alleged victim girl as also the petitioner no.1 as regards his reputation and professional progression.

Learned Counsel appearing on behalf of the State denies the allegations. However, he submits that the State would not come in the way, if a direction is passed.

No prejudice will be caused to anyone if a direction is passed to expedite the proceeding.

It appears that the charge sheet was submitted in time, in 2022. However, thereafter, there has been some delay occasioned in conducting the proceeding.

In view of the above and in the interest of justice for all, let the Special Court conclude the proceeding in accordance with law and as expeditiously as possible by fixing shorter dates and by keeping in mind the statutory stipulations as contained in the said Act regarding expeditious disposal of the proceeding.

With these observations and directions, the revisional application is disposed of.

It is clarified that the merits of the case have not been gone into. 9.
Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
