1. Learned advocate appearing for the petitioners submits that the petitioners are in custody from 27th September, 2025 and the subject matter of alleged recovery in the present case is 1.187 kg of brown sugar. Although charge-sheet has been submitted but charge, till date, has not been framed. Prosecution has relied upon seven (07) witnesses in order to prove its case. As such, the petitioner prays for bail on any stringent condition.

2. Learned advocate for the State opposes the prayer for bail.

3. I have taken into account the chemical examiner's report also which satisfies the judgment of the Hon'ble Supreme Court in

Sentu Seikh vs. State of West Bengal [SLP (Crl.) No. 13987 of 2025].

4. Having regard to the factum of rigours of Section 37 of the NDPS Act being attracted, I am not inclined to release the petitioners on bail.

5. At this stage, the prayer for bail of the petitioners is rejected.

6. Accordingly, CRM (NDPS) 1002 of 2026 is dismissed.

7. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.

8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
