For the Petitioner Mr. Sayanti Santra ... for the State The petitioner is directed to serve a copy of this revisional application upon Ms. Sayanti Santra, Learned Advocate, who ordinarily appears on behalf of the State. Her appearance may be regularised by the concerned authority. Learned Advocate for the petitioner submits that the instant case was initiated in the year 2012. Charge-sheet was submitted in the year 2013 and, since then the same is pending for appearance of other accused persons and the petitioner, being diligent is regular in Court and is facing agony because of the pendency of the proceedings for the last 11 years.

I have considered the submissions advanced by the Learned Advocate for the petitioner and, I am of the view that the anxiety, as expressed by the Learned Advocate for the petitioner, is justified.

Accordingly, the Learned Metropolitan Magistrate, 19th Court, Calcutta, is directed to issue harsher process of law for compelling appearance of the other accused persons. After exhausting such process, the Learned Trial Court would segregate the case and proceed with the trial of the case. Needless to state that the Learned Trial Court, once commences the trial, would take endeavour by fixing one date in every fifteen days so that the trial is concluded within a period of 12 months from the said date. The Learned Trial Court would, in the fitness of circumstances, seek the services of the Deputy Commissioner of Police in charge of North Port P.S. for execution of process in respect of the other accused persons for ensuring appearance of witnesses in course of the trial. With the above observations, CRR 1597 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
