Challenging an order dated February 25, 2026 passed by the learned District Judge in-Charge, South 24 Parganas in Alipore in Misc. Appeal No. 53 of 2026 arising out of Title Suit No. 1567 of 2025, petitioner has approached this Court.
Mr. Banerjee, learned advocate appearing for the petitioner submits that in order to bypass a caveat lodged by the 5th defendant, the petitioner was not impleaded as a party-respondent in the memorandum of appeal filed by the opposite-party no. 1 in the Misc. Appeal No. 53 of 2026. He submits that the leaned Judge of the appellate court, by the order being no. 1 (later) dated February 25, 2026,
directed the appellant to take necessary steps to deal with the defect. He submits that such a liberty could not have been granted to the appellant. When the provision of Order 41 Rule 20 of the Civil Procedure Code was pointed out, Mr. Banerjee, in his usual fairness, did not dispute that such defect could be allowed to be removed within the period of limitation for preferring an appeal. He, therefore, on instruction, prays for leave to withdraw this civil revision application.
Accordingly, CO 1571 of 2026 stands dismissed as withdrawn.
