Petitioner seeks electricity connection.

Learned advocate for the petitioner submits that, although CESC Authorities are agreeable to provide electricity supply to the petitioner, the private respondent obstructed CESC Authorities for doing so.

Learned advocate appearing for the CESC Authorities submits that, the private respondent obstructed the CESC Authority from inspecting the premises. He seeks police protection.

A person in settled possession is entitled to electric supply. In the facts of the present case, the petitioner applied for electric supply and CESC Authorities are willing to provide the same. CESC Authorities were prevented from inspecting the immovable property where the

electric supply is to be affected.

In such circumstances, it would be appropriate to permit the CESC Authorities to approach the local police station for police protection. Once approached the local police station will ensure adequate police protection to the CESC Authorities to complete the inspection. On completion of all formalities and payment of all cost and charges and subject to the CESC Authority finding supply of electricity is feasible on inspection, they will proceed to give electric supply to the petitioner. In the event the CESC Authorities find any obstruction from any quarter in providing electric supply to the petitioner, they are at liberty to approach for police for protection. The police are directed to provide the same. Needless to say that the petitioner will bear all costs, charges and expenses for police protection. It is expected that the entire exercise will be completed within a period of four weeks from date.

WPA 11368 of 2021 is disposed of accordingly without any order as to costs.
