The petitioners have claimed that they have been thrown out of their residence by the private respondent(s). To that effect, they informed the Officer-incharge of Entally Police Station. Records of the case reflect that a civil suit has been filed which is pending before the learned Civil Judge (Sr. Divn.), Sealdah being T.S. 126 of 2023.

Learned advocate for the State

submits that the earlier representation was that the petitioners had left their residence and they were never thrown away from their residence as claimed by them.

Learned advocate for the private respondents submits that the civil court is already in seisin of the issues and a status quo order has already been passed by the learned civil court.

Having regard to the fact that the civil court is already in seisin of the issues and the petitioner No.1 claims to be a senior citizen, the petitioners, if so advised, will approach the appropriate authority and/or Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The concerned authority and/or Tribunal will hear out the parties, and thereafter, pass necessary directions.

In case, directions are passed upon the police authorities, the police

authorities will respect, obey and implement such order.

With the aforesaid observations, WPA 10482 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
