1. By this public interest writ petition, the petitioners seek for implementation of the directions given by the District Magistrate & Collector, South 24-Parganas upon the Block Land and Land Reforms Officer, Pathar Pratima by order dated 2nd December, 2022 and also for implementation of the directions given by the Block Land and Land Reforms Officer, Patharpratima, South 24-Parganas by order dated 17th February, 2023.

2. By the said order, the private respondents were directed to restore the land to its original character within seven days.

3. The learned Advocate General, on instruction, submitted that the private respondents were heard by the authority and thereafter the order has been passed, which has not been challenged till date. In the said order, it has been stated that if within seven days, the private respondents do not restore the scheduled

mentioned land to its original character, action will be taken as per provisions of section 4D of the West Bengal Land Reforms Act, 1955.

4. It appears that the private respondents have not challenged the order dated 17th February, 2023 and have not implemented the directions issued therein.

5. Therefore, we direct the Block Land and Land Reforms Officer, Pathar Pratima, South 24-Parganas to take further action in terms of section 4D of the West Bengal Land Reforms Act, 1955 within a period of eight weeks from the date of receipt of server copy of this order.

6. With the above directions, the writ petition is disposed of.

7. No costs.

8. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
