1. This contempt application has been filed alleging willful disobedience of the order and direction passed by this Court on 29.11.2021 in F.M.A. 1088 of 2019.

2. A compliance report has been filed by the Municipal Commissioner, Kolkata Municipal Corporation but the compliance report is bereft of any detail.

3. Learned advocate for the applicant submits that roughly about Rs. 8,000/- per month has been paid as pension to the applicant whereas similarly placed persons have been paid Rs. 22,000/- per month as pension.

4. In the absence of any break-up details as to how pension has been quantified, it cannot be stated as to whether the applicant would be entitled to more than what has been paid to him as pension as of now.

5. In order to set things right, we direct the Municipal Commissioner, Kolkata Municipal Corporation or any other authority, who is in-charge of the matter, viz., Chief Manager (SRAC Pension, PF, GI, HBA & Staff Quarter, the KMC to communicate the entire break-up details as to how the pension and gratuity was computed and how the assessment was made etc.

6. Such information should be furnished to the applicant through the learned advocate on record by speed post with acknowledgement due within three weeks from the date of receipt of server copy of this order.

7. Upon going through the information and break-up details, if the applicant feels aggrieved, it will be well open to the applicant to take further steps in accordance with law.

8. With the aforesaid directions, the contempt application and the connected application (I.A. No. CAN 1 of 2024) are disposed of.
