.... Petitioners Mr. Navanil De Mr. Subhrajit Dey ...for the petitioners Mr. Krishnendu Bhattacharyya, Ld. APP Mr. L. Vishal Kumar Mr. Bikash Kr. Singh ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the parents of the principal accused, who is a minor. It is alleged that the minor accused held the hand of the minor victim girl and gave her an indecent proposal. When a complaint was made in that regard, the petitioners allegedly went to the house of the victim and assaulted her family members. The petitioners have been falsely implicated in this case. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the FIR, the statements of the victim as well as the statements of neighbours. However, there is no injury report present in the case diary.

From the statements of independent witnesses, it appears that after the incident involving the minor victim and the minor accused,

the present petitioners went to the house of the victim, denied the allegations and thereafter a scuffle took place. Others had to intervene to prevent the happening of any untoward incident. It is indeed very surprising that instead of scolding their own child, the petitioners decided to go the house of the minor victim girl and threaten her parents.

However, the petitioners are not the principal accused in this case.

Considering the above, the other materials available in the case diary, the alleged roles ascribed to the present petitioners and the fact that charge sheet has already been submitted, while I am inclined to grant anticipatory bail to the petitioners, their movement needs to remain restricted for a limited period.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date and shall attend the jurisdictional Court regularly. The petitioners shall not threaten or intimidate the witnesses. The petitioners shall stay outside the jurisdiction of Nandigram Police Station for a period of two months from this date except for meeting the I.O. or attending the jurisdictional Court.

The application for anticipatory bail is, thus, disposed of.
