Mr. Ujjal Ray ...for the Petitioner Mr. Shamim ul Bari, Ms. Keya Sutradhar ...for the Respondent Nos. 6 & 7 It is the grievance of the petitioner that based on an allegation of plagiarism, the college authority deleted the name of the petitioner from the electoral role for the election of Governing Body of the relevant college under Kazi Nazrul University, Paschim Bardhaman.
It is also the grievance of the petitioner that the college on the basis of the said allegations has not granted him the promotion from Assistant Professor Stage II to Assistant Professor Stage III.
On behalf the college, it has been submitted that the petitioner admitted his guilt and resigned from all administrative positions, including the membership of the Governing Body.
The college further submits that a new Governing Body has been constituted and the petitioner did not participate in the election. I am of the view that there is no scope to pass any order at this stage with regard to participation of
the petitioner in the administrative function of the college.
No document has been produced before this Court to show that the petitioner had ever applied under Career Advancement Scheme for his promotion from Assistant Professor Stage II to Assistant Professor Stage III.
Whatever might be the allegation, the petitioner has a right to be considered for the promotion. This writ petition is disposed of with a direction upon the college to process the application, if any, filed before the college for granting him promotion for Assistant Professor Stage II to Assistant Professor Stage III. If no such application has yet been filed by the petitioner for his promotion, he will be at liberty to file application before the college and the same shall be considered in accordance with law.
Accordingly, WPA 10554 of 2023 is disposed of.
