1. Affidavit of service kept with the record.

2. The writ application has been preferred challenging an order dated 31.07.2024 (Form R, Memo No.1577/1/G-215/22/EL/LC) passed by Respondent No.2, the Controlling Authority under the Payment of Gratuity Act, 1972, in Gratuity Case No.G-215 of 2022, directing the petitioner to pay Rs.2,94,782/- (Rupees Two Lakh Ninety Four Thousand Seven Hundred and Eighty Two Only) comprising alleged gratuity principal of Rs.1,99,852/- and interest of Rs.94,930/- to Respondent No.4, issued by the Controlling Authority under the payment of gratuity Act, 1972, Kolkata.

3. Admittedly, the petitioner has not preferred a statutory appeal against the impugned order. Two years have passed, since the order has been

passed and certificate proceedings have been initiated.

4. On hearing the Learned Counsels for the petitioner, perusal of the record, and considering the huge delay in not challenging the impugned order in appeal before the Appropriate Authority, this Court is not inclined to interfere with the said order, which appears to be prima facie in accordance with law.

5. Considering the further prayer of the petitioner, the writ application is disposed of with liberty granted to the petitioner to pray for instalments, before the Certificate Officer to pay the gratuity as granted and the Certificate Officer, shall consider the same, in accordance with law, the certificate proceeding also be disposed of expeditiously.

6. The writ application stands disposed of.

7. Applications, if any, connected thereto stand disposed of consequently.

8. Interim order, if any, stands vacated.

9. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
