It is the specific contention of the Officer-inCharge, Canning Police Station, that the complaint dated September 25, 2020, allegedly filed by the petitioner, was never served upon the Officer-inCharge, Canning Police Station. It is further submitted that when the petitioner had complained of the physical and mental torture by his wife, General Diary No. 391 dated October 7, 2020 was registered. It is further stated that the police authority spoke to the parties and directed the petitioner to submit a written complaint before the Officer-in-Charge, Canning Police Station.

Under such circumstances, if the petitioner files a complaint before the police authorities, the police authorities shall act and proceed in accordance with law.

If the petitioner approaches the police authorities with a prayer to be escorted back to his house, the police authority shall render assistance. The writ petition is disposed of. There shall be no order as to costs.
