1. Learned Advocate appearing for the petitioner submits that the seizure list witness did not support the prosecution case and the present petitioner has been implicated on the basis of subsequent recovery effected. As such the petitioner may be released on bail.

2. Learned Advocate for the State submits that the subject matter at the initial seizure is 10,000 bottles of Codeine Phosphate and subsequently another 40 bottles which were recovered at the behest of the petitioner.

3. Mr. Rajendra Banerjee, learned APP along with Mr. R. Mukherjee was directed to appear. Their appearance may be regularized by the concerned authorities.

4. I have taken into account the huge quantum of seizure in the present case and the fact as submitted is that nine witnesses have been examined out of the proposed fourteen witnesses.

5. Having considered the same I direct the learned Trial Court to expedite the process and complete rest of the five witnesses preferably within a period of six months.

6. At this stage the prayer for bail of the petitioner is rejected considering the fact the complicity of the present petitioner in the present case as well as his antecedents.

7. Thus, CRM (NDPS) 987 of 2026 is dismissed.

8. Memo of evidence be kept with the record.

9. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
