(AB) Mr. Biswarup Bhattacharya Mr. Debabrata Das Mr. Durbadal Sen ......... for the petitioner Mr. Soumya Majumder Mr. Victor Chatterjee ........... for the Visva-Bharati The petitioner is aggrieved by an undated communication issued by the In-charge, Centre for Journalism and Mass-communication, Visva-Bharati whereby petitioner has been communicated that his service as Field Officer on purely temporary basis is no longer required at the centre. The service of the petitioner has been dispensed with immediate effect. The petitioner received the aforesaid communication on 24th March, 2021 and has preferred an appeal before the Karma Samiti, VisvaBharati on 18th April, 2021. The said appeal preferred by the petitioner is yet to be disposed of by the University.

As it appears that the representation filed by the petitioner being aggrieved by the order of dispensing his service is pending consideration at the end of the University, no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the respondent No. 6 being the Karma Samiti (Executive Council), before whom the representation has been filed, to dispose of the same strictly in accordance with law, at the earliest, but positively within a period of six weeks from the date of communication of a copy of this order.

The aforesaid respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter. The petitioner shall be afforded an opportunity of hearing prior to passing the order in consideration of the representation filed by the petitioner.

The writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
