...... petitioners Mr. Prabir Majumder ...... for the petitioners Mr. T k Ghosh Mr. Arindam Sen ...... for the State It is submitted on behalf of the petitioners that they are the in-laws of the victim housewife and they have been falsely implicated in the instant case. Allegation of attempting to set the victim housewife on fire relates to 2019 but no contemporaneous complaint was lodged.
Learned lawyer for the State opposes the prayer for anticipatory bail.
We have considered materials on record. Allegation of strangulating the victim housewife is against the husband and not the petitioners. No contemporaneous complaint was lodged with regard to the incident which occurred in 2019, which according to the petitioners was due to an accident.
In view of the aforesaid facts and circumstances of the case and keeping in mind the extent of complicity of the petitioners in the alleged crime, we are inclined to grant anticipatory bail to the petitioners.
Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount, to the satisfaction
of the Arresting Officer and also be subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
Petitioners shall appear before the court below and pray for regular bail within four weeks from date.
