1. Learned advocate appearing for the petitioner submits that the petitioner has been implicated in the instant case for the alleged recovery of 260 grams of heroin and is in custody for eight months. Prosecution intends to examine seventeen (17) witnesses and till date, charges have not been framed.

2. Mr. Gauranga Kumar Das, learned Additional Public Prosecutor, along with Amartya Mohan Bhattacharyya, learned Advocate was directed to represent the State in the present case. Their appearance may be regularized.

3. Learned advocate for the State submits that the recovery is of commercial quantity. Chemical examiner's report does support the defence case.

4. Having considered that the quantum of seizure in the present case is of commercial quantity, I am not inclined to release the petitioner on bail at this stage.

5. Petitioner would renew the prayer for bail after evidence of seizure list witnesses are over. Learned Trial Court would expedite the process of consideration of charges and within a period of 60 days from the date of framing of charge shall complete the examination of seizure-list witnesses.

6. At this stage, the prayer for bail of the petitioner is rejected.

7. Accordingly, CRM (NDPS) 992 of 2026 is dismissed.

8. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
