1. Affidavit-of-service filed in Court today be kept on record.

2. The grievance of the petitioner is that an application under Section of the Securitization And Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act, 2002) is pending since October, 2021 before the concerned District Magistrate, that is, the respondent no. 2 herein, although the statutory period of disposal of such applicatsions is sixty days.

3. It is submitted that a direction be passed for expeditious disposal of the said application.

4. It is further submitted that the hearing of the matter was concluded as long back as on May 17, 2022.

5. Despite service, none appears on behalf of the respondent.

6. In view of the innocuous nature of the order proposed to be passed, further service is not directed.

7. WPA No. 10568 of 2023 is accordingly disposed of by directing respondent no. 2, the District Magistrate, North 24 Parganas, to dispose of the pending application filed by the petitioner under Section 14 of the SARFAESI Act, 2002, by passing an order thereon as expeditiously as possible, positively within three weeks from the date of communication of this order to the respondent no. 2.

8. There will be no order as to costs.

9. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
